Updates on recent legislative and regulatory activity impacting workers' compensation pharmacy

The MyMatrixx by Evernorth Regulatory Affairs team continually tracks and monitors legislation and regulations impacting workers’ compensation pharmacy. Below are some updates on more recent developments. You can follow many of these measures and more with our online tracker.

Alaska discussing pharmaceutical concerns

The Alaska Workers’ Compensation Division’s Medical Services Review Committee has been reviewing potential updates to the medical fee schedule as part of their summer meetings. During the June 26 meeting, the committee discussed pharmaceutical issues and concerns, including physician dispensing and compounded, topical, and repackaged medications. The MyMatrixx by Evernorth Regulatory Affairs team attended this meeting and provided information on what other states have done to address some of those topics and referenced provisions already in place in Alaska’s laws. Additional meetings are scheduled for July 17 and August 7. The public is permitted to listen in and provide comments during the meetings at designated times.

Florida bill amends provider reimbursement petition timeframes

Florida Senate Bill 1452, a larger bill addressing the state’s Department of Financial Services, was signed by the governor on June 26. The bill amends the workers' comp law to:

  • Increase the submission timeframe for health care provider reimbursement petitions from 45 days to 60 days after receipt of notice of disallowance or adjustment of payment
  • Allow service by common carrier with verifiable tracking methods rather than just through certified mail
  • Increase the carrier timeframe for submitting any documentation substantiating its disallowance or adjustment in response to the Division of Workers’ Compensation from 30 to 45 days from receipt of the petition.
  • Adjust the frequency at which the “Three-Member Panel” must submit recommendations to the President of the Senate and the Speaker of the House of Representatives on methods to improve the workers' compensation health care delivery system.

Mississippi fee schedule correction to re-add topical cap language

In the adopted June 1, 2026, updates to the Mississippi Workers’ Compensation Commission’s medical fee schedule, prior fee schedule language which capped reimbursement for manufactured (non-compounded) topical medications was inadvertently removed. MyMatrixx and other stakeholders recommended to the Commission that this issue be addressed to avoid a potential loophole and increased costs. Formal notice of the proposed correction to re-add the topical cap language was published by the Commission on June 29, with a planned amendment date of September 1, 2026. No changes will be made to the prior language being added back in, which provides the maximum allowable reimbursement for manufactured topical medications (other than patches) is the billed charge up to a maximum of $30 for a 30-day supply, prorated if a lesser amount is provided.

SAWCA Annual Convention

The Southern Association of Workers’ Compensation Administrators (SAWCA) is holding its 78th annual convention from July 13-17, 2026, in St. Pete Beach, Florida. SAWCA is an organization made up of 22 workers’ compensation jurisdictions (state agencies) and industry organizations from across the country. MyMatrixx is an associate member of SAWCA and a sponsor of this year’s event. The convention and other SAWCA events provide opportunities for regulators and industry participants to share perspectives and best practices to help improve the workers’ compensation systems in multiple states.
